Investment Methodology & Portfolio Management

The Originator has deep expertise in pricing, financing, and managing legal assets. Contingency Capital is focused on a broad spectrum of legal assets including loans to law firms, portfolio financing, and distressed special situations investments where the primary driver is related to a legal, tax, or regulatory process.

As opposed to traditional legal finance managers who invest in individual cases with binary outcomes, the fund employs a private credit model that emphasizes capital preservation while using legal, tax, regulatory, and insurance assets as collateral. Contingency Capital plans to focus on three strategies; loans to law firms, distressed special situations with litigation catalysts, and investments in corporate litigation portfolios. The firm often ties the availability of capital to the value of the underlying legal assets.


Management

Brandon Baer (Founder and Chief Investment Officer)

Prior to creating Contingency Capital, Brandon was a partner and Managing Director in the Credit Funds business at Fortress Investment Group where he was the Co-Founder and Co-Head of the Legal Assets Group from its inception until his departure in 2019 to form Contingency Capital. While at Fortress, he focused on litigation finance, distressed debt, and special situations, with an emphasis on complex, illiquid private investments including litigation-related assets.


Prior to working at Fortress, he was a Senior Vice President of D.E. Shaw & Co. where he was a member of the corporate credit-related strategies unit. He began his career at a leading international law firm, Wilkie Farr & Gallagher. He received his JD, cum laude, from Harvard University and BA, summa cum laude, from Princeton University.
